Fairer and Faster Property Division in Sweden
We demand a modernization of the rules governing property division in order to shorten processing times, reduce costs and strengthen legal certainty – particularly for the financially weaker party and children.

1. Six months – no extension
As a general rule, a property division should be completed within six months. The time limit should be clear and should not be extendable because one party deliberately delays the process.
2. Restored legal aid and property division support
Restore legal aid and introduce specific property division support with cost caps and fixed fees for standardized procedures, financed by the state. A person’s financial circumstances should not determine their ability to protect their legal rights.
3. Certified property division administrators and legal representatives
Introduce certification for property division administrators and legal representatives, mandatory written information to clients about their rights and obligations, and clear ethical rules preventing undue pressure to accept a settlement.
4. More efficient access to information and disclosure obligations
Strengthen the obligation to disclose information and the ability to obtain necessary information in a timely manner. Banks and the Swedish Tax Agency should, when necessary for the property division, be able to provide information despite confidentiality rules. This could, for example, be handled through the Swedish Enforcement Authority.
5. Independent review of decisions by property division administrators
Decisions made by property division administrators should be subject to review and approval through an independent oversight function. The Swedish National Audit Office could be given an overarching supervisory and auditing role to ensure legally secure and consistent application of the rules.
6. Clear rules and consideration of children and gender equality
Introduce codified and fair rules regarding compensation for the use of jointly owned property, prevent forum shopping, and ensure that the consequences for children and gender equality are considered at every stage of the process.

Overall, these reforms should shorten processing times, reduce costs and strengthen legal certainty for the financially weaker party and for children.
