Prosecutors who wield the power of the State to incarcerate citizens should abide by the federal and state constitutions and take seriously their mandate to only pursue cases for which there is sufficient evidence. As a defense attorney prosecutors have often told me they themselves are being forced to prosecute a case by their supervisors. If individual prosecutors feel pressure to obtain convictions they should be able to stand by their decision not to prosecute a case with insufficient evidence - being able to point to sanctions provides the reason to stand up to supervisors if necessary and adhere to the constitution.
