We seek the immediate removal of the principal of Effingham Heights Secondary School due to a complete loss of confidence in their leadership. The actions taken under the principal’s authority resulted in learners being unlawfully denied access to education, exposed to unsafe conditions, subjected to discriminatory and inconsistent enforcement of rules, and deprived of their constitutional rights. These actions demonstrate a serious failure of judgment, leadership, and duty of care, rendering the principal unfit to continue in this role.

How can it be implemented?

The KwaZulu-Natal Department of Education must urgently institute a formal investigation and disciplinary process, place the principal on precautionary suspension pending the outcome, and appoint interim leadership to restore lawful, fair, and child-centred governance at the school. The Department must then proceed with the removal and replacement of the principal, ensuring that future school leadership complies fully with constitutional obligations, education law, and the best interests of learners.

Reason

This petition is important because the actions of the principal on the first day of the school term violated learners’ constitutional rights to education, equality, and safety. By denying access to school for minor uniform or grooming issues, failing to accommodate religious practices, and leaving learners unsupervised outside the school, the principal breached their duty of care and put students at risk.

The petition seeks to protect the rights and well-being of all learners, hold school leadership accountable, and ensure that education at Effingham Heights Secondary School is safe, fair, and lawful. Removing a principal who demonstrates a clear disregard for learners’ rights is necessary to restore trust, maintain proper governance, and prevent future violations.
