Petition addressed to: Cape Town City Manager
THE CITY MUST ACT. PUBLIC OPEN SPACE CANNOT BE LEFT UNMANAGED.
We, the undersigned residents, call on the City of Cape Town to urgently investigate the encampment on the public open space between the Kuils River and Fairtrees Road, Durbanville, and enforce all applicable by-laws and PIE Act if applicable.
Residents should not have to watch a public open space become an established encampment while concerns about sanitation, waste, fire hazards, environmental damage and public safety remain unaddressed. The City must inspect the site, establish which laws and by-laws apply, and take effective action where contraventions are found.
This is not a demand to criminalise homelessness. It is a demand for consistent enforcement, responsible management of public land and a lawful, humane response. Durbanville has previously experienced prolonged public concern about encampments, unhygienic conditions and perceived municipal inaction. In 2022, a public petition concerning an encampment in Baxter Street attracted more than 2,500 signatures, and the City subsequently obtained a High Court order concerning the serving of eviction notices to unlawful occupants. The City must not wait for conditions to deteriorate before acting.

OUR DEMANDS
We call on the City of Cape Town to:
- Conduct an urgent site inspection of the encampment between the Kuils River and Fairtrees Road and document the current conditions.
- Enforce applicable by-laws where unlawful occupation, dumping, fires, sanitation violations or other contraventions are established.
- Address environmental and public-health risks, including accumulated waste, human waste, potential pollution of the river corridor and any fire hazards identified during the inspection.
- Implement a lawful plan to address the encampment, including the appropriate legal process where removal of unlawful occupation is necessary.
- Provide social-development outreach and information about available shelters and support services to people living at the site.
- Prevent the site from becoming a permanent unmanaged encampment through appropriate monitoring, maintenance and follow-up enforcement.
- Consult CAPEXIT and affected residents and provide a written response identifying the responsible City departments, the proposed action and clear timeframes.
ENOUGH OF REACTIVE MANAGEMENT. WE DEMAND RESULTS.
Public open spaces must be properly managed. Environmental protection, sanitation, public safety and human dignity are not mutually exclusive. The City can provide appropriate social support while enforcing the law and protecting public land.
We therefore demand visible action, consistent by-law enforcement and a sustainable solution for the open space between the Kuils River and Fairtrees Road.
