Nintendo claimed that they are suing under patent infringement but have not informed neither pal world or the people what , this could set a dangerous precedent. As without warning or a chance to correct it Nintendo is using the legal system as a weapon to destroy any competition (imagine making breakfast and your neighbors sue you for making a similar breakfast and won't tell you what exactly happened to make them go nuclear).
