The residents of Richmond Hill at a quarterly community meeting mandated the Richmond SRA to oppose any future applications for rezoning of homes to allow for student accommodation.

The following application has been lodged:

Zamagcina Dantile on behalf of Bentifield Pty Ltd the registered owner of Erf 2954, Port Elizabeth Central situated at 7 Zereba Street, Central, intends to apply for the:

  1. The amendment of the Nelson Mandela Bay Integrated Land use Scheme, 2023 by the Rezoning of Erf 2954, Port Elizabeth Central from General Residential Zone 3 to General Residential Zone 2;
  2. The relaxation of the street building line and both lateral building lines applicable to Erf 2954 Port Elizabeth Central;
  3. The relaxation of the off street-parking requirements from 3 bays to 2 parking bays applicable to Erf 2954 Port Elizabeth Central.

Reason

The reasons for opposing the application are:

The suburb already has a problem with student accommodation as the student behaviour is often noisy and disruptive to residents.
The property is in an area predominantly occupied by families and working residents. Introducing accommodation for 11 students in a single dwelling will fundamentally change the character of the street through:

  • Increased noise, social disturbance, and late-night activity.
  • Strain on limited street parking and infrastructure (the application already seeks to reduce the required bays).
  • Traffic congestion, waste-management challenges, and potential safety issues.

The use of the property for student accommodation is inconsistent with the intent of the existing zoning, the character of our neighbourhood, and the requirements of the Nelson Mandela Bay Municipality’s Student Accommodation Policy (2018) and related planning legislation under the Spatial Planning and Land Use Management Act (SPLUMA, Act 16 of 2013).

The Municipality’s adopted Student Accommodation Policy (2018) explicitly requires that:
“Every Student Accommodation establishment must have a Student Accommodation Manager who will reside on the property 24 hours a day and is expected to ensure that the Code of Conduct is enforced.”

In this application, no residence manager has been identified, nor has any indication been given that the owner intends to appoint one or reside permanently on the property. It is understood that the owner resides approximately four hours away in East London, which makes daily supervision and compliance enforcement impossible.

This directly contravenes the core management requirements of the policy and undermines its purpose — namely, to ensure that student housing is secure, professionally managed, and compatible with surrounding communities.

Failure to demonstrate a compliant management plan should, by itself, disqualify the application.

Typically the value of the property and those in the vicinity is affected by a lack of proper maintenance and the activities of the students.
Richmond Hill's sewage, water and power services are already under severe strain. Adding to the population density will exacerbate the problem.
Proposed alterations to the house will affect the historical nature of the suburb.

Why people sign

We, home owners or residents of Richmond Hill, strongly oppose the rezoning of homes (mostly all heritage homes) and buildings in Richmond Hill for student accommodation.

This change is unnecessary and has already led to a rise in crime and disturbances following previous student housing resoning schemes. Richmond Hill should be a safe, family-oriented area and not another student hub.

There are many vacant buildings in Central that are far more suitable for student housing. Research already supports Central as the best area for this purpose. Close to schools, transport, student facilities as well as larger commercial buildings that are far more applicable for housing schemes. The municipality can and should do more to create by laws for vacant buildings and absent owners. Fix this you’ll fix the housing shortage for students.

I urge to stop further rezoning in Richmond Hill and instead focus student accommodation developments / rezoning in Central.

Own my property. Must keep our area residential. Currently have students living next door. Noisy, no respect, so students should stay on a campus. Also students use uber constantly. Bring unnecessary activity in area at all times of night
