Petition for Quarry Opposition/Legal Compliance

FORMAL PETITION AND COMPLAINT REGARDING UNLAWFUL QUARRY OPERATIONS
To: The Homeowners Association (HOA), Relevant Municipal Authorities, and Environmental Regulatory Bodies
Subject: Urgent Petition Opposing Quarry Operations Adjacent to a Residential Estate and on Agricultural Land
We, the undersigned residents of Eye of Africa Estate, formally raise our objection to the ongoing quarry operations adjacent to our residential community.
The quarry appears to be operating in contravention of zoning regulations, environmental legislation, and land-use permissions, given its proximity to a residential estate and its location on agricultural land. The scale and intensity of activity strongly suggest non-compliance with regulatory requirements.
Operations occur six to seven days per week for approximately 12 hours daily, historically from as early as 05:00 to 17:30. While prior intervention led to temporary compliance, operations have resumed from 06:00 as of 05 May. Residents have collected video and photographic evidence of these activities.
We acknowledge the efforts of the Mayor of Midvaal, who previously pursued legal action against the operators. Although unsuccessful, this resulted in short-term improvements. Unfortunately, non-compliance has since resumed.
The impacts on residents and the environment are significant:

• Noise Pollution: Persistent early-morning and intermittent loud noises (including suspected blasting and heavy machinery) severely disrupt sleep and daily life.
• Air Pollution: Dust and airborne pollutants compromise air quality, forcing residents to keep windows closed, with indoor environments still affected.
• Health Concerns: Increased respiratory issues and allergies, particularly among children.
• Reduced Quality of Life: Ongoing noise and poor air quality affect wellbeing and productivity.
• Environmental Impact: Operations on agricultural land disrupt wildlife habitats and negatively affect local ecosystems and domestic animals.
• Property Devaluation: The presence of a quarry is incompatible with the estate’s intended residential and environmental standards, undermining property values and expectations.

Despite complaints to Midvaal Municipality since August 2024, no lasting resolution has been achieved. The recurrence of these activities requires urgent intervention.
We respectfully request:

1. Immediate investigation into the legality of the quarry operations.
2. Suspension of activities pending the outcome.
3. HOA engagement with legal and environmental experts to pursue appropriate action.
4. Collaboration with authorities to enforce applicable laws.
5. Transparent communication with residents on progress and actions taken.

This situation is no longer sustainable. We urge immediate action to protect residents, property, and the environment.
