​Subject: Plea for a Sentencing Reflecting Habitual Offending and Community Impact

​Preamble and Purpose
​We, the undersigned members of the Hoekwil Community, supported and formally endorsed by the Hoekwil Ratepayers and Residents Association (HRRA), respectfully submit this petition to the Court.

We wish to formally draw the Court's attention to the sustained and detrimental impact of habitual criminal activity by the individual known as Arrie Fortuin on the safety, peace, and welfare of our community.

​This petition is a collective plea that, upon any future conviction of the aforementioned individual, the Court gives full and due consideration to the long history of repeated, although often petty, offenses, and imposes a sentencing option that is commensurate with the status of a habitual criminal.
​Statement of Fact and Concern

Habitual Nature: Despite numerous arrests and previous short sentences or alternative dispositions, the pattern of criminal behavior has not been deterred. This shows a disregard for the law and the rehabilitation attempts made by the justice system.

Impact on Community: While individual crimes (e.g., theft, vandalism, trespassing) may be minor, their frequency and persistence have a severe cumulative effect, leading to:

  • ​Widespread fear and anxiety among residents, particularly the elderly.
  • Financial burden through repeated property damage and loss.
  • A loss of faith in the effectiveness of the justice system to protect the community.


Community Endorsement: The Hoekwil Ratepayers and Residents Association, representing the unified voice of the community, formally endorses the contents of this petition.

Plea for Sentencing

We respectfully urge the Court to consider the following in its deliberations:

  • That the pattern of re-offending classifies the accused as a habitual offender.
  • That the principle of deterrence must be prioritized in this instance to protect the community from continued victimization.
  • That the imposition of the maximum appropriate sentence for the current charge, or a sentence structure that ensures a meaningful period of incarceration and rehabilitation, is necessary to break the cycle of crime and restore peace to Hoekwil.
