Request to increase protections for residents, ratepayers, farmland, and water resources in the proposed Data Center Ordinance
The undersigned residents, landowners, and stakeholders respectfully petition the APC and the Ordinance Task Force to strengthen the proposed Data Center Ordinance before it is advanced for recommendation or adoption.
Accordingly, this petition requests that the ordinance be revised to include the following minimum protections:
· Increased setbacks: Require a minimum setback of 1325 feet from residences, schools, churches, and other sensitive uses. A 2-mile setback for Municipalities.
· Building size cap: Limit any data center building to 100,000 square feet.
· Cooling-water protections: Prohibit open-loop cooling systems and impose strict limits on any discharge of contaminated or heated water.
· Natural gas generator limits: Prohibit or strictly limit natural gas generators and require the strongest available standards for emissions, noise, and hours of operation.
· Special exception review: Require every data center proposal to obtain a Special Exception rather than being allowed by right.
· Resident electric-rate protections: Require enforceable protections so that residential customers do not bear electric infrastructure or rate increases attributable to data center development.
Razones.
The Renewable Energy Ordinance is similar, and Data Centers are more intensive in nature than Renewables. Data Centers have the capacity to strip this county of natural resources.
Protections are required for the safety and health of the county residents

The current ordinance allows a Data Center to be 500 feet from the exterior walls of a residence. My property is particularly affected since we will essentially be “boxed in” on three sides by the data center and the fourth side is the highway.
It may be legal, but it is unethical to leave us as sitting ducks on the “promise” that the developer will make it right. It’s not the developer’s responsibility to make it right. It’s the county’s responsibility to keep us safe!
I don't want a data center to drain our lakes, have a bright light at night that obscures God's stars, and cause the cost of living to go up for the surrounding towns. We also don't have the energy to support this. There isn't enough research on environmental and agricultural safety. More research and updated safety protocols are needed for these data centers before they are implemented. Additionally, they need a system, almost like a refrigerated system, to keep them cool, similar to what computers use.
