Soil and water are a huge concern for the residents with this potential change.
Signees in this petition wish to express strong opposition to application 24-2000-0011, Modern Land and Development, LLC, requesting a zoning change from Open Space District (OS) to an Agricultural-
Recreational District (A), for 160-acre parcel and a 741.32-acre parcel owned by Ruby Mountain Ranch
Holdings, LLC, adjacent to the Spring Creek Association, Palace Heights. Application 24-2000-0011, Modern Land and Development, LLC
Reason
Why are we against it?
- The landowner and developer are requesting the zoning change to create 5 acre lots in this combined area of 901-acres, adjacent to Spring Creek Association, Palace Heights.
- Access to the new subdivision would likely be through the Spring Creek Association via Palace Parkway.
- While this parcel may be private land, it is also a key headwater to Butterfield Creek, and remaining winter habitat for Mule Deer in a key travel corridor. Allowing the zoning change for future development would not only change the aesthetics, quiet, and dark space of the community but also displace the wildlife that currently calls it home.
More details to consider:
- Water!
- 80 5-acre parcels would require 360 ac-ft of water to be secured (2 acre-feet/new parcel)
- (roughly another 120 million gallons of water)
- Combined with the mountain parcel also up for re-zoning, a total of 1097 acre-feet of water tied up for houses, that will no longer be available for ag, wildlife, or mining purpose.
- Will impact 5 small cul-de-sac roads (Black oak, Cripple Creek, Wolf Creek, Eagle Creek & Sumac Dr.), along with significantly increasing traffic on Palace Parkway. Who will pay the additional maintenance costs?
- Soils for these two parcels are rated as “very limited” for Septic Systems noting slow water movement, seepage in bottom layer, and depth to cement pan. These very limited soils could lead to system failures with impacts to both ground and surface waters.
- Soils for these two parcels are rated as “very limited” to “limited” for road development due to dust, frost heave, shrink and swell, causing negative effects for air quality and maintenance issues into the future.

Debate
The road infrastructure is already burdened with traffic, there isn't enough water to support the project and its expensive enough already, this project will only benefit a handful of individuals who are already greedy! Do not commercialize the Ruby Mountains with a ski resort.

We don’t have enough water as it is out here. If I wanted to live in a community that is over populated I would move to the city. I like it out here just the way it is. Please no more homes.
Keep the !@#$! Californians and everyone else who thinks this is ok off of our native animals lands! Plus we do not have the water to support this!!
