According to World Health Organization (WHO), Miraa consumed in its natural state is not a drug but a mild botanical stimulant with insignificant effect to public health. In 1994, it was politically classified as a drug by NACADA under Narcotic Drugs and Psychotropic Substances Act 4 of 1994. In 2016, Kenyan government listed Miraa as a scheduled cash crop under Crops Act, Cap. 318. The Narcotics Act (s.87) gives the executive (The President or Cabinet Secretary for Ministry of Interior and National Administration) the direct legal power to add or delete substances from the Act’s Schedules.
Miraa is the lifeblood of, WE, the Ameru people. It is a sacred thread woven through our culture, economy, spirituality, and social identity. It shapes every aspect of our human experience and binds generations together in purpose, pride, and heritage. MIRAA IS NOT A DRUG. DELETE FROM NACADA

Uzasadnienie

Deleting miraa from NACADA’s classification will restore its rightful place as a social-cultural symbol of unity and identity among the Ameru, strengthen economic livelihoods for thousands of farmers and traders, and revive religious and spiritual traditions that honor miraa as a sacred medium of peace, truth, and reconciliation. Legally, it will correct a historical misclassification that criminalized culture, while politically, it will enhance government credibility, promote equity in agricultural policy, and reaffirm Kenya’s commitment to protecting indigenous heritage and sustainable rural development.
